Terms of Service

1. Acceptance of Terms

By accessing or using StoryKind ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all users, including parents, guardians, and teachers who create accounts on behalf of children.

2. Description of Service

StoryKind provides AI-generated personalised children's stories, comprehension quizzes, vocabulary tracking, and reading analytics. Stories are generated based on the child's name, age, interests, and reading level provided by the parent or guardian.

3. Eligibility and Parental Consent

• The Service is intended for children ages 3-10, under the supervision and consent of a parent or guardian.
• A parent or guardian must create the account and provide verifiable parental consent before any child profile is created, in compliance with COPPA.
• By creating a child profile, you represent that you are the parent or legal guardian of that child.

4. Subscription and Billing

• Free accounts include a limited number of stories per period as described on our Pricing page.
• Paid subscriptions are billed monthly or annually as selected at checkout.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Refunds are provided at our discretion for unused portions of annual plans within 14 days of purchase.
• If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from digital subscriptions, starting from the day you subscribe. By starting to use the Service during this period (e.g., generating stories), you consent that the service begins immediately and acknowledge that you lose the right to withdraw for the used portion.
• Gift codes are non-refundable and expire after the stated period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract AI models or generated content at scale
• Share account credentials with unauthorised third parties
• Upload or input content that is abusive, harmful, or violates the rights of others

6. Intellectual Property

• Firmify EOOD ("Firmify"), a company registered in Bulgaria (UIC 208745197), operating StoryKind, retains ownership of the platform, AI models, and generated content. Generated stories may be processed by third-party AI providers as described in our Privacy Policy.
• You are granted a non-exclusive, non-transferable licence to use generated stories for personal, non-commercial use within your family.
• Stories may be printed or saved for personal use; commercial redistribution is not permitted.

7. Teacher and Classroom Use

Teachers may create classroom groups and invite parents to link their children for reading progress tracking. StoryKind is not a school official record system and does not claim blanket FERPA compliance on its own. Schools and districts requiring a Data Processing Agreement (DPA) should contact [email protected]. Teachers can only view reading data for students whose parents have explicitly enrolled them in the class.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. StoryKind does not guarantee uninterrupted availability, specific reading level improvements, or that AI-generated content will be free from occasional inaccuracies. All generated content is reviewed by automated safety classifiers, but we cannot guarantee that every story will be perfect.

9. Limitation of Liability

To the fullest extent permitted by law, StoryKind shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes constitutes acceptance of the new Terms.
